1. Rental Package and Term. Customer agrees to rent reusable moving/storage totes for a rental period of fourteen (14) calendar days beginning on the Rental Start Date. The rental fee is due before or at the time the totes are delivered, picked up, or otherwise made available to Customer.
2. Condition of Totes. Customer acknowledges that the totes are being provided in usable condition. Customer agrees to inspect the totes upon receipt and notify Business immediately of any missing, damaged, cracked, broken, or unusable totes. If Customer does not notify Business of an issue within 24 hours of receiving the totes, the totes will be considered received in good and usable condition.
3. Customer Responsibility. Customer agrees to use the totes only for normal moving, packing, storage, or transportation purposes. Customer agrees not to overload, misuse, alter, cut, burn, paint, mark, puncture, drill, or otherwise damage the totes. Customer is responsible for all totes while they are in Customer's possession, care, or control.
4. Damaged or Broken Totes. If any tote is returned broken, cracked, damaged, missing a lid, unusable, or otherwise not in rentable condition, Customer agrees to pay a replacement fee of $20.00 per damaged or broken tote. This fee is in addition to the rental fee.
5. Lost, Missing, or Unreturned Totes. All totes must be returned by the Rental Return Due Date unless Business approves an extension in writing. If any tote is lost, missing, stolen, not returned, or not made available for pickup on the scheduled return date, Customer agrees that Business may charge $20.00 per unreturned tote. Failure to return the totes does not transfer ownership of the totes to Customer unless Business confirms otherwise in writing.
6. Credit Card Authorization. Customer agrees to provide a valid credit or debit card to be kept on file by Business during the rental period. Customer authorizes Business to charge the card on file for: (1) the selected tote rental package; (2) any broken, damaged, lost, missing, or unreturned totes; (3) any agreed rental extensions; (4) any unpaid balance owed under this Agreement. Customer agrees not to dispute valid charges made under this Agreement if the charges are for rental fees, replacement fees, damage fees, missing totes, or other amounts authorized by this Agreement.
7. Late Returns and Extensions. Customer must return or make the totes available for pickup by the Rental Return Due Date. Rental extensions are subject to availability and must be approved by Business in writing before the original return date. If Customer keeps the totes beyond the agreed rental period without written approval, Business may charge additional rental fees or replacement fees if the totes are not returned after demand for return.
8. Pickup and Delivery. Tucson Tote Drop will make reasonable efforts to deliver and pick up totes within the agreed time windows. Customer agrees to make all totes available at the agreed pickup location and time. If Business arrives for pickup and the totes are not available, Customer may be responsible for additional pickup, rental, or replacement charges.
9. Cleaning and Prohibited Use. Customer agrees to return the totes reasonably clean and free from trash, food, liquids, chemicals, hazardous materials, pests, odors, or personal property. Customer agrees not to use the totes for illegal materials, hazardous substances, open liquids, food waste, medical waste, chemicals, flammable materials, animals, or anything that may contaminate or damage the totes. Business may refuse to accept contaminated totes and may charge Customer the replacement fee for any tote that cannot safely or reasonably be cleaned and rented again.
10. No Ownership Transfer. The totes remain the property of Business at all times. This Agreement is a rental agreement only and does not give Customer ownership rights in the totes.
11. Customer Property. Customer is responsible for removing all personal property from the totes before returning them. Business is not responsible for any items left inside returned totes.
12. Limitation of Liability. Customer agrees that Business is not responsible for damage to Customer's property caused by improper packing, overloading, misuse of totes, weather exposure, transportation, or Customer's handling of the totes. Customer agrees to use reasonable care when lifting, carrying, stacking, or transporting totes.
13. Collection Costs. If Customer fails to pay amounts owed under this Agreement, Customer agrees to be responsible for reasonable collection costs, payment processing fees, court costs, and attorney fees to the extent permitted by law.
14. Entire Agreement. This Agreement contains the entire understanding between Business and Customer regarding the tote rental. Any changes must be agreed to in writing by both parties.
15. Governing Law. This Agreement shall be governed by the laws of the State of Arizona, unless another state's law is required by applicable law. Any disputes shall be resolved in Pima County, Arizona.
16. Customer Acknowledgment. By signing below, Customer acknowledges that they have read, understood, and agreed to this Agreement, including the rental price, two-week rental period, $20.00 per tote replacement fee, and authorization to charge the card on file for damaged, lost, missing, or unreturned totes.
